The Date and time for your first court date will be at the bottom of your notice to appear, for those notices that look like a traffic ticket.  If they give you an

8 1/2" x 11" notice, it can be an anywhere on the document.  If you bailed out with a bail bondsman, then there will be no notice to appear.  In this event, the bondsman would give you the date.  You must appear in court on all felony filings, but if you secure a law firm to represent you, then the attorney will be able to represent you in your absence.

Riverside County District Attorney:

Each of the County Courts have a corresponding office of the District Attorney. The Office of the District Attorney is the law enforcement branch of the court system, that decides whether your case has facts sufficient to prosecute.  This county is what we call conservative.  They believe that issuing tougher penalties for crimes keeps the community at large safer.  These individuals are experienced, government lawyers.  They are your opposition. They are the individuals with whom we negotiate in order to make you the best deal to close your case (in the event that you have no dismissal issues in your police reports).

Riverside County Court Specific DUI Penalties

Riverside County Superior Court Penalties:

Our website lists penalty ranges for DUI for the State of California on our DUI Court Penalties Page.  However, those penalties have a vast range so that the different courts in California may choose what they consider appropriate in their county. If a case does not have a dismissal issue, then these are the penalties we must work through with the court:

Like all counties, Riverside County has penalties specific to the Riverside County Court System.  The most notable ones are listed below:

  • First Offense DUI- 20 days jail minimum

  • Collisions- 10 days jail

  • 2nd Offense DUI cases- 30 days jail minimum and one year IID interlock device on your car (breath machine)

  • 3rd Offense DUI- 120 days jail minimum

  • High Alcohol Levels (.15% or more)- additional jail

Riverside County Superior Court Jail Alternatives:

  • Secured Electronic Monitoring- So long as the Judge does not object and you live within the county, you may apply for this program so long as the judge does not object.  Instead of jail, you would be at home.  You may work, go to school and other life's necessities, but otherwise must be at home. If the Judge checks a box on the plea form denying SEC that acts as a court order prohibiting it.

  • Work Release Program-  Work Alternative Program- each 8 hour day of work, supervised by the Riverside County Sheriff substitutes for a day of jail.
