These are the currently active criminal courts which make up the Orange County Superior Court. The court that you are assigned, will depend upon where you were initially pulled over or where the traffic collision occurred. The Date and time for your first court date will be at the bottom of your notice to appear, for those notices that look like a traffic ticket.  If they give you an 8 1/2" x 11" notice, it can be an anywhere on the document.  If you bailed out with a bail bondsman, then there will be no notice to appear.  In this event, the bondsman would give you the date.  You must appear in court on all felony filings, but if you secure a law firm to represent you, then the attorney will be able to represent you in your absence.

Orange County District Attorney:

Each of the courts above have local offices of the O.C. District Attorney.  The Office of the District Attorney is the law enforcement branch of

the court system, that decides whether your case has facts sufficient to prosecute.  This county is what we call conservative.  They believe that issuing tougher penalties for crimes keeps the community at large safer.  These individuals are experienced, government lawyers.  They are your opposition. They are the individuals with whom we negotiate in order to make you the best deal to close your case (in the event that you have no dismissal issues in your police reports).

Orange County Court Specific DUI Penalties

Orange County Superior Court Penalties:

Our website lists penalty ranges for DUI for the State of California on our DUI Court Penalties Page.  However, those penalties have a vast range so that the different courts in California may choose what they consider appropriate in their county. If a case does not have a dismissal issue, then these are the penalties we must work through with the court:

Like all counties, Orange County has penalties specific to the O.C. Court System.  The most notable ones are listed below:

  • Collisions- 10 days physical labor

  • First Offense- typically no jail, unless there are special enhancements added to the complaint.

  • 2nd Offense DUI cases- 60-90 days jail minimum and one year IID interlock device on your car (breath machine)

  • 3rd Offense DUI- 180 days jail minimum

  • High Alcohol Levels (.15% or more)- additional jail

  • All DUI cases- immediate driver license confiscation upon a plea in open court

  • DNA Registry-  Normally required only in felony cases, this is required when entering into a deal with the D.A. on all cases (misdemeanors too).

Orange County Superior Court Jail Alternatives:

  • SEC- Secured Electronic Monitoring- So long as the Judge does not object and you live within 70 miles of the office of Probation, you may apply for this program.  Instead of jail, you would be at home.  You may work, go to school and other life's necessities, but otherwise must be at home. If the Judge checks a box on the plea form denying SEC that acts as a court order prohibiting it.

  • DUI Court Program- even when SEC is denied, jail may be avoided by being accepted into the Orange County DUI Court Program.  This program was the brain child of Judge Carlton Biggs of Harbor Justice Court.  His vision was an extended support group run by the court.  A one year long program that meets several times a month.  The goal being to prevent people from re-offending.  Since its inception around 2000, all of the Orange County Courts will refer to this program for consideration, upon request. You must be accepted after a thorough review and we guide you through that process. You must:

  1. Live and work in Orange County​

  2. Never have been through DUI Court before.

  3. Be deemed a person who would benefit from the program.

  4. Have no history of violence or flight risk
