These are the currently active criminal courts which make up the Los Angeles County Superior Court.  There are other L.A. County courts and the court administration may change what each court handles from time to time. The court that you are assigned, will depend upon where you were initially pulled over or where the traffic collision occurred. The Date and time for your first court date will be at the bottom of your notice to appear, for those notices that look like a traffic ticket.  If they give you an 8 1/2" x 11" notice, it can be an anywhere on the document.  If you bailed out with a bail bondsman, then there will be no notice to appear.  In this event, the bondsman would give you the date.  You must appear in court on all felony filings, but if you secure a law firm to represent you, then the attorney will be able to represent you in your absence.

Each of the courts above have local offices of either the Los Angeles County District Attorney or The Los Angeles City Attorney's Office.  Both are prosecutorial agencies.  The District Attorney works for the County of Los Angeles and The City Attorney works for L.A. City.  Some of the Los Angeles County Courts have both agencies prosecuting cases within them. 

Los Angeles County District Attorney:

The Office of the District Attorney is the law enforcement branch of the court system, that decides whether your case has facts sufficient to prosecute.  This office is generally conservative and offers less cooperative dealings with your case.  These individuals are experienced, government lawyers.  They are your opposition. They are the individuals with whom we negotiate in order to make you the best deal to close your case (in the event that you have no dismissal issues in your police reports).

Los Angeles City Attorney:

The Los Angeles City Attorney is a prosecutorial agency like the District Attorney's Office.  The difference is that the City Attorney works for the City and not the County and they solely prosecute misdemeanors, while the District Attorney prosecutes both misdemeanors and felony cases.

The Office of the City Attorney is the law enforcement branch of the court system, that decides whether your case has facts sufficient to prosecute.  This office is generally reasonable to deal with as opposed to some other, more 'conservative' as the District Attorney's offices.  Like the District Attorney, City Prosecutors are experienced, government lawyers.  They are your opposition. They are the individuals with whom we negotiate in order to make you the best deal to close your case (in the event that you have no dismissal issues in your police reports).

Los Angeles County Court Specific DUI Penalties

Los Angeles County Superior Court Penalties:

Our website lists penalty ranges for DUI for the State of California on our DUI Court Penalties Page.  However, those penalties have a vast range so that the different courts in California may choose what they consider appropriate in their county. If a case does not have a dismissal issue, then these are the penalties we must work through with the court:

Like all counties, Los Angeles County has penalties specific to the Los Angeles Court System.  The most notable ones are listed below:

  • All first offense DUI convictions- 0 days county jail minimum six month maximum (no jail typically unless there are aggravating facts.

  • Collisions- 10 days additional cal trans

  • 2nd Offense DUI cases- 4 days jail minimum up to one year

  • 3rd Offense DUI- 120 days jail minimum up to one year

  • High Alcohol Levels (.15% or more)- additional jail

Los Angeles County Superior Court Jail Alternatives:

  • Electronic Monitoring- So long as the Judge does not object, you may be referred to private electronic monitoring.  You would pay for the service and avoid jail by being at home for 50% of the sentence. You may work, go to school and other life's necessities, but otherwise must be at home. Less experienced attorneys will get you denied every time; We've seen it happen in court time and time again.  But there is a way to get EMP on misdemeanors and some felonies, but you have to know how to go about it.  That's what we do for you!

  • ​Cal Trans- Sheriff Work Alternative Program is in lieu of jail.  It is an 8 hour work day that you apply for and schedule with the Sheriff.  Each day counts for a day of jail, however you do get good conduct credits.  You must have prosecutorial permission to convert jail to work service.
